Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the PropG mobile application and any related services (collectively, the “Service”), operated by PropG Tech(“PropG”, “we”, “us”). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. The Service is intended for use by real estate agents, sub-brokers, and brokerage firms operating in India.

2. Your Account

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must provide accurate, current, and complete information at registration.
  • One account per person. You may not share your account with others.

3. Acceptable Use

You agree not to:

  • Upload any customer or buyer information without the lawful basis to do so under applicable data-protection laws (including India's Digital Personal Data Protection Act, 2023).
  • Use the Service to send unsolicited messages or spam.
  • Attempt to gain unauthorised access to the Service or other agents' data.
  • Reverse-engineer, decompile, or otherwise attempt to extract source code from the Service.
  • Use the Service for any unlawful purpose or to upload content that infringes third-party rights.
  • Misuse the AI assistant to generate misleading, fraudulent, or otherwise harmful content.

4. Your Content

You retain ownership of all property listings, buyer records, and notes you upload to PropG (“Your Content”). You grant PropG a limited, non-exclusive licence to host, store, process, and display Your Content solely to provide the Service to you.

You represent that you have the legal right to upload Your Content, including any third-party personal information (such as buyer contact details).

5. AI Assistant

PropG includes AI-powered features (powered by Anthropic's Claude). AI outputs can be inaccurate or incomplete. You are responsible for verifying any information before relying on it for business decisions or sharing it with customers. PropG is not liable for decisions made based on AI outputs.

6. Pricing & Credits

Core CRM features are currently free. Some premium features (such as additional credits, contact reveals, or expanded matching) may require payment. Where charges apply, the price and what you receive will be clearly shown in-app before you pay.

We may change pricing for new purchases at any time. We will not change the price of a subscription or credit pack you have already paid for.

7. Suspension & Termination

We may suspend or terminate your account at any time if we reasonably believe you have breached these Terms, used the Service unlawfully, or put other users at risk. You may delete your account at any time by emailing admin.propg@gmail.com.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure against every possible threat.

9. Limitation of Liability

To the maximum extent permitted by law, PropG's aggregate liability arising out of or relating to these Terms or the Service will not exceed the amount you paid us in the twelve months preceding the claim, or ₹1,000, whichever is greater. We will not be liable for any indirect, incidental, special, consequential, or punitive damages.

10. Indemnification

You agree to indemnify and hold PropG harmless from any claims, losses, or damages arising out of your breach of these Terms, your misuse of the Service, or your violation of any third party's rights — including unlawful upload of personal information about third parties.

11. Changes to the Service or Terms

We may update the Service and these Terms from time to time. If we make material changes, we will notify you (for example, via email or an in-app notice). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka.
